Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of AI Rails ("the Platform"), provided by AI Rails, Inc. ("we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Acceptable Use

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Platform
• Use automated systems to access the Platform without permission
• Generate content that is illegal, harmful, or misleading
• Reverse engineer or attempt to extract source code

Intellectual Property

The Platform and its original content, features, and functionality are owned by AI Rails, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create using the Platform. By using the Platform, you grant us a limited license to process and store your content as necessary to provide our services.

Payment and Billing

Certain features of the Platform require a paid subscription. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase
• Authorize us to charge your payment method on a recurring basis
• Provide accurate billing information

We reserve the right to change our pricing at any time. We will provide notice of any price changes before they take effect.

Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms or any applicable law
• Is harmful to other users or third parties
• Exposes us to legal liability

You may terminate your account at any time by contacting us or using the account settings feature.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI RAILS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF THE PLATFORM.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
